SFA - different rules no doubt!

A victory of sorts over the SFA but we may still cop it from FIFA as we were ordered to withdraw our court action and didn't.
The SFA appeals committee could have hit us with a fine, suspension or expulsion - they chose fine and a transfer embargo - they may look at it again and chose fine and suspension or expulsion which would be a far worse punishment of course than a transfer embargo.
We should just have accepted the embargo, had as good a year as possible with the players we still have which would have seen us still finish 1st or 2nd and use the money saved to plan a great season in 2013/14.

Don't know if this will be the end. A few Rangers/Hearts fans were discussing it at work today.
They said there is a rule that if you go outside of the 'judiciary' of the SFA then you go against the SFA constitution and punishment for this could be expulsion from the SFA.
I only picked this up from fans and it was my understanding, other may know more.
Didn't someone not mention something similar a while a go about going to the Court of Arbitrition for Sport and the English FA don't like it.

You will find you are safe on this one. The FIFA rule is that you can sue your county FA, but will incur punishment,ie be banned by FIFA, if you sue your national FA.
Your club did not sue the SFA, and so FIFA can posture, but will be in direct conflict with there own laws if they try to punish you further.

This is at the moment a repeat of the Sion Saga. And is over the witheld taxes saga.
Rangers went to the Court of Session (think High Court in England/Wales), against the SFA, to overturn the transfer embargo for bringing the game into disrepute.
Going to court is against the articles of the SFA, UEFA and FIFA unless it is CAS.
The problem for Rangers is that the only other option for punishment for the SFA to consider was deemed "too harsh" and that is now back on the Table., they thought the maximum fine was "too lenient"
Also consider the appellate panel had a supreme court judge on it, and the original panel had a top QC on it and they saw nothing wrong with the transfer embargo.
Hopefully it doesn't get to the point of the SFA being chucked out by FIFA and UEFA as they consider that Rangers HAVE sued the SFA

Rangers appealed against a decision, I think you will find they did not sue. Slight difference, but a difference.
There is no 2 ways about it, sue tour national FA and FIFA will, not may, ban you, is the law, so I doubt any club would be stupid enough to go against that.

I think your man from Tynecastle is right, FIFA doctrine stipulates no civil court action whether suing/appealing against the national football authority, SFA in this case. The only place this should have been heard is at the CAS but D&F decided not to go there (because they would not win).Ron wrote:Jambo,

The SFA recognises their own appeals process as well as CAS and FIFA but they do not need to abide by a civil court decision if it is in relation to a ruling stipulated within the laws of the game. They can choose to ignore it as they are governed by FIFA and their laws. The court would have to challenge FIFA direct and if it did then FIFA may expel the SFA and Scotland teams from all competitions.
This is now a huge dilemma for the SFA. Under FIFA/UEFA pressure they may end up making it worse for Rangers and subsequently for the Scottish Football. Very sad, feel sorry for the Gers fans especially the 40,000 or so season annual ticket holders.
