That's what it is on the EvoStik, North West Counties and Cheshire League.

The FA came a cropper over this and had to change to an independent disciplinary panel.

The NL statement seems to say the NL are bringing the charges and selecting the disciplinary panel.

IF that is the case, they will struggle to claim it is a fair process

It may be the other leagues have got away with it because no one wants to challenge it in court because they couldn't afford it, but if all the clubs being charged here stand together, they could afford the legal costs to bring such a case


However, at the moment its still hypothetical as we have not reached that stage yet....lets see what the NL do next week when the 7 days are up....especially if vote is to end season...The NL would look foolish disciplining or trying to discipline clubs for not playing games in a season that has ended

The whole thing is a shambles all round

On what is possibly a lighter note Chester FC attempted to hold a zoom meeting to update supporters.

I am told that the update was just starting when it was hacked / interrupted by what seemed to be some foreign pornographic site.

After a break the meeting resumed and the manager began to speak only for the meeting to be interrupted again. I am told that this time it was by someone with a foreign accent shouting obscenities.

I do not know if they managed to discuss anything of substance before the meeting was ended.

If Kidderminster are adamant they want to play, we are going to have to take a stand and take the threatening legal letters like the others I suppose. It may be frozen but surely we won’t be leaving it until a potential late pitch inspection to make a statement. They often give as long as possible to allow for daytime thaw.

According to the NL communique sent to Southport
National League takes action against clubs not fulfilling fixtures

By the league's rulebook, an unfulfilled fixture can result in a points deduction or expulsion from the competition, as well as the opposition being awarded points.

Southport received a letter from the league in which said "The league has been made aware you are considering not fulfilling a scheduled league fixture on Saturday, February 13. I am therefore required to remind you of the league rule 8.39, specifically:

"'Any club without just cause failing to fulfil an engagement to play a competition match on the appointed date shall for each offence be liable to expulsion from the competition and/or such other disciplinary action the board may determine, including the deduction of up to a maximum of three points from the offending club’s record, any expenses incurred by their opponents, and a fine.

"'In the event of a club being in breach of the previous paragraph of this rule then the board may award points to the club not at fault as if the match had been played and the league table shall reflect the position as if the match had been played with the result awarded by the board.'

"The league requires by 12pm Friday, February 12 your definitive position whether you are refusing to play a scheduled league fixture on Saturday, February 13 so the league can act accordingly"

DJ has been on the Non League Show podcast, stating we lost around 50k in January.

The situation is completely untenable and I think we should refuse to play from Saturday onwards.

On the 1st February, the National League started a petition which stated:
National League clubs are facing catastrophe and a perilous situation in the next few days.

We need a sustainable lifeline that does not leave clubs facing future ruin.

After changing the terms of its support in the middle of the season, the government must reverse its decision to offer loans and now fulfil its promise of a new grant.

Our clubs play an immeasurable role in communities all over the UK and provide immense structures of support for many.

Current government loan offers have moved the financial goalposts mid-season and jeopardised the future of our clubs.

Without adequate and fair funding, the National League will not survive, with consequences felt by thousands of players, supporters and club staff across the UK for many years to come.
Clubs are now attempting to avoid the "catastrophic and perilous situation" that will have "consequences felt by thousands of players. supports and staff for years to come", by refusing to play, furloughing staff and effectively shutting down.

Now the National League are issuing letters threatening the very same clubs with sanctions, it is an absolute circus.

I hope that the above wording is utilised in any legal action/response directed to the National League by these clubs, or us if we have to.

Spen also makes a very good point, the National League are appointing its own sub-committee to carry out the case hearings. This may be seen to be adversarial and another stick to beat the incompetent National League with.

That seems about in line with what was said at start of season doesn't it.

It won't take into account "reserves" but that is basically the situation a monthly deficit of £50k from now until the end of the season if the league progresses.

Probably best for him to remember those fund raising ideas, considering the debt they will be racking up if the season continues. And of course, not forgetting who Hartlepool's chairman is...

They have reiterated that their season is finished.

That statement you quote from the NL most definitely needs to be used against them if this ends up in litigation

Blyth statement says they have been fined, not sure the league can do that just yet and maybe wording of Blyth's statement. I presume they respond to the charge before they would be fined.

I think Blyth might have updated their statement. It currently states they "have been charged".

This is interesting. The first chairman on is from Gloucester, he is proper full of himself and loves the limelight, D.J appears at about 55 minutes and keeps on the level, explaining the situation very well. It’s a long podcast but both presenters are amazed at how inept and out of touch Barwick and the league board are.

With the notable exceptions of Bury and Macclesfield Town, very few clubs and their supporters will understand the devastating impact of when a football club goes out of business.

Maidstone United were in that position in 1992. It is not a position the current owners will allow on their watch.
Maidstone sadly miss a more obvious example but their point is valid.

Gateshead have announced that they will not be travelling to Fylde to play tomorrow as they are unwilling to bare the costs for what may be a meaningless game. We have clearly stated that we do not wish to continue the league season without grants so surely we need to follow the stance taken by Heed and Spenny.
If it means we have to forfeit the FA Trophy tie with Hornchurch then that would be a great pity but surely our integrity is more important. Am I the only one becoming more uncomfortable with our present position which is beginning to look untenable to me.

At present Old Git our position is we are playing. We haven’t missed a game yet. Listening to the podcast it looks like we are playing on for now.
But why are we playing?
Are we scared of the NL rulers ?
Do we want to play on because of the FA Trophy?
